Terms of Service

These terms cover BoothKits Booth: the Windows app, the web booth, the online galleries and the operator dashboard (together, "the Service"), provided by BoothKits ("we", "us"). By downloading, installing or using the Service you agree to these terms. If you don't agree, please don't use the Service.

1. Your license

While you have an active free trial or paid subscription, we give you a non-exclusive, non-transferable license to install and use the Service for your own photo booth business on up to the number of booths your plan includes (currently 2). You may not resell, sublicense, rent or share your license key, or let more booths use it than your plan allows.

2. Free trial

New accounts get a 14-day free trial with every feature. No payment details are needed. When the trial ends, features that need a subscription stop working until you subscribe.

3. Subscriptions and billing

• Subscriptions are billed in advance, monthly or yearly, through our payment processor, Stripe.
• Subscriptions renew automatically at the end of each period until you cancel.
• You can cancel at any time on the subscription page. You keep access until the end of the period you've already paid for.
• We may change prices. Any change applies from your next renewal, and we'll tell you before it does.
• Refunds are covered by our Refund Policy.

4. Your content and your guests

Photos, videos, designs and guest details you capture or upload ("Your Content") belong to you or your guests. You give us permission to store, process and display Your Content only as needed to run the Service, for example to show galleries and send photos to guests.

You are responsible for Your Content and for how you use the Service at your events. That includes getting any consent your guests or the law require before photographing them, collecting their contact details or sending them messages, and following the privacy laws that apply to you.

5. AI features

AI portraits and cartoon effects are created by automated systems and can be unpredictable. Review results before printing or sharing. Don't use AI features to create content that is illegal, hateful, sexual, or that imitates real people without their permission.

6. Acceptable use

You agree not to reverse-engineer or tamper with the Service or its license checks, use it for anything illegal, upload content you don't have the rights to, or interfere with the Service or other customers.

7. Availability and changes

We work to keep the Service running and to improve it, and we may add, change or remove features. The booth keeps working offline, but online features depend on internet access and outside services. We don't guarantee the Service will always be available or error-free. Please test your setup before every event.

8. Disclaimer

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, to the extent the law allows.

9. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost bookings or lost data. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim.

10. Ending your use

You can stop using the Service at any time. We may suspend or end access if you break these terms or don't pay. Online galleries for a cancelled account may be removed after a reasonable notice period.

11. Governing law

These terms are governed by the laws of the State of New York, United States, without regard to conflict of law rules.

12. Changes to these terms

We may update these terms. If we make an important change we'll tell you in the app or by email. Using the Service after a change means you accept the new terms.
